Please read the terms and conditions applicable to the Fox Chalet accommodation unit.

SC NETEA GROUP SRL , as the owner of the website www.foxchalet.com , reserves the right to modify or update the website content, the Terms and Conditions, as well as the Reservation Policy at any time, without prior notice.

Definitions

Fox Chalet = the accommodation unit where the Guest is hosted;
Tihna Spa House = the unit where spa activities take place within Fox Chalet;
Barn Gathering House = the unit where group activities take place within Fox Chalet;
Guest = the person in whose name the reservation at Fox Chalet is made and who pays for the services to SC NETEA GROUP SRL;
Reservation – once the reservation is made by the Guest, they implicitly accept these Terms and Conditions, which have the legal value of a contract.

PART I – ACCOMMODATION

Services

Fox Chalet undertakes to provide the Guest with all services purchased as part of the selected service package.

In the event that Fox Chalet is unable to fully provide the contracted accommodation and meal services (exceptional cases such as floods, technical failures, earthquakes, etc.), Fox Chalet undertakes to offer the same package, with identical services, in another accommodation unit.

The reservation confirmation at Fox Chalet is made via an automated email containing the reservation details, sent to the email address provided during the online booking process. Guests are requested to ensure that the email address provided is correct.

For check-in, guests must present a valid identity document, which will be verified upon arrival.

The rate at which the Guest purchases the package cannot be modified subsequently. Accommodation rates may vary throughout the year depending on promotional offers (Last Minute, Early Booking, Black Friday); however, the Guest may not modify the rate of a package that has already been purchased or confirmed.

CHECK-IN

Check-in time: 15:00

The Guest is required to show up for check-in at the time specified in the reservation confirmation. If the Guest arrives before the official check-in time, they acknowledge that accommodation prior to this time cannot be guaranteed.

The Guest is required to pay at reception any applicable local taxes (tourism tax, sanitation tax, or other local taxes), without the right to request compensation or refunds from Fox Chalet.

The Guest must present valid identity documents for all adults and birth certificates for the children, as well as the accommodation confirmation issued by Fox Chalet. In the absence of identification documents, the Guest acknowledges that access to the accommodation may be refused, without refund or compensation of the amounts paid.

If the number of adults and/or children declared in the reservation differs from the number present at check-in, the Guest is required to pay the corresponding difference for accommodation and meals. If the total number of persons exceeds the maximum capacity of the reserved room, the Guest acknowledges that not all persons can be accommodated.

If, upon arrival, the age of a child differs from that declared in the reservation according to the birth certificate, the Guest is required to pay any applicable rate differences at reception.

Stay

Fox Chalet undertakes to provide the Guest with all services purchased through the reservation.

The Guest acknowledges that certain services are not included in the purchased package and may require additional payment.

The Guest undertakes not to damage the property of the Fox Chalet accommodation unit. In the event of damages occurring during the stay, the Guest agrees to bear the cost thereof.

The Guest is directly responsible for any damages caused to the room or the accommodation unit, including furniture, appliances, linens, towels, tableware, sanitary objects, the courtyard, and landscaping elements (trees, plants, decorative elements), regardless of whether such damages are caused by the Guest, their children, or their guests.

If such damages are not reported and are discovered after the guest’s departure, Fox Chalet reserves the right to recover the cost of the damages by debiting the card used to guarantee the reservation and, where applicable, the card used for the reservation. Fox Chalet also reserves the right to debit the Guest’s card for the value of missing items. By accepting these Terms and Conditions, the Guest expressly agrees to the recovery of the value of damages and/or missing items by debiting the card used to guarantee the reservation, within the limits of the established damage. Upon the Guest’s request, Fox Chalet may provide a description of the identified damages and, where applicable, supporting documents.

If Fox Chalet is unable to recover the damages directly from the Guest or by debiting the card, the Guest agrees that the competent authorities may be notified to resolve the situation.

LOST ITEMS

Lost items will be shipped if the owner is clearly identifiable and the home or business address is known. Shipping costs and risks are covered by the Guest.

GENERAL RULES

FOX CHALET IS A NON-SMOKING PROPERTY.

Fox Chalet is a strictly non-smoking property. Smoking is not permitted inside any indoor areas, including bedrooms, bathrooms, common areas, and event spaces.

In case of violation, a cleaning and deodorization fee of €250 will be charged to the guest responsible. Additional damages may be charged if necessary.

Smoking is permitted only in designated outdoor areas specifically marked for this purpose.

Balcony smoking is strictly prohibited.

Cigarette butts must be fully extinguished and disposed of in the provided receptacles. Improper disposal of smoking materials is strictly forbidden due to fire risk.

Given the mountain location and wood structure of the property, fire safety is of utmost importance. Any violation of this policy will result in additional cleaning fees, damage charges, or immediate termination of stay.

For group bookings, the booking organizer is responsible for ensuring that all participants comply with this smoking policy.

FOX CHALET DOES NOT ALLOW PETS ON THE PREMISES.

By exception, service animals are accepted, in accordance with applicable legislation.

CHECK-OUT

Check-out time: 10:00

The Guest agrees to vacate the room by the official check-out time.

Late check-out is subject to availability and must be requested in advance at reception.

At check-out, the Guest is required to settle any outstanding balance.

If the Guest leaves the property without paying the outstanding balance, they agree that the competent authorities may be contacted to recover the amount due.

If the Guest chooses to leave before the scheduled check-out date, they acknowledge that they will not receive refunds, compensation, or alternative services for unused nights.

MEALS

Fox Chalet undertakes to provide all meal services included in the Guest’s reservation. If Fox Chalet is unable to provide meal services, it undertakes to offer the same meal conditions at another unit.

The Guest acknowledges that no additional meal services beyond those purchased are included.

The Guest agrees to comply with the meal schedule and order. If the Guest misses a meal for personal reasons, no compensation or refund will be granted.

DAILY FITNESS AND MOVEMENT ACTIVITIES

Within the Fox Chalet accommodation unit, light movement activities, fitness, light physical exercises, yoga, stretching, hikes, breathing, or other similar activities may be organized, carried out in the Barn Gathering House or other designated areas.

Participation in these activities is optional and undertaken at the Guest’s own responsibility.

The Guest declares that they are physically fit to participate in movement activities and do not suffer from medical conditions that prohibit physical effort or could be aggravated by participation.

Fox Chalet does not provide medical services or evaluations and does not issue medical or personalized recommendations regarding health status or appropriate effort levels. Guests are advised to consult a physician before participating in movement activities, especially in the case of existing medical conditions, recent surgeries, or pregnancy.

Fox Chalet reserves the right to refuse a Guest’s participation in movement activities if there are reasonable safety-related concerns.

Fox Chalet cannot be held liable for injuries, lesions, pain, or other health issues occurring during or as a result of participation in fitness and movement activities, except as expressly provided by law.

Activities may be led by internal staff or external collaborators, who do not provide medical or therapeutic services.

CANCELLATIONS, PENALTIES, COMPENSATIONS

If the Guest cancels purchased tourist services for personal reasons, the following penalties apply:

Non-refundable services

100% of the package value for non-refundable Standard packages, regardless of the cancellation date;
100% of the package value for Early Booking, Black Friday, or Last Minute packages;
Non-refundable reservations cannot be modified, canceled, or refunded for any reason (illness, death, personal reasons, etc.);
If the Guest cannot arrive for personal reasons, the tourist’s name may be changed.

Flexible services

The Guest may modify the stay period up to 20 days before arrival, subject to availability. The amount paid will be considered an advance and applied to the new reservation. Any rate difference will be paid by the Guest;
Modifications or cancellations made less than 20 days before arrival are penalized at 100% of the total stay value;
One free modification is permitted.

GDPR

In accordance with applicable data protection legislation, including Regulation (EU) 2016/679 (GDPR), SC NETEA GROUP SRL processes personal data securely and exclusively for specific purposes, including accommodation registration, contract performance, invoicing, reservations, and communications regarding offers and events.

Personal data may be disclosed to contractual partners and service providers (e.g., booking platforms, payment processors, IT providers), solely to the extent necessary for service provision and the fulfillment of legal/contractual obligations, in accordance with the Privacy Policy Guests have the right of access, rectification, erasure, or restriction of data processing.

PART II – TIHNA SPA HOUSE

Liability Waiver for Spa Services

The Guest declares that they are fully informed about the services or treatments to be provided, as well as about their own physical limitations, and that they are able to assess the risks associated with accepting such services. They acknowledge that medical conditions, allergies, or medication (oral or topical) may be influenced by the requested treatments or services and that they have had the opportunity to discuss these aspects with the service provider.

The Guest acknowledges that the decision to benefit from these services belongs exclusively to them. If the therapy causes any injury, pain, or discomfort, they will immediately inform the provider and discontinue the services.

Use of the outdoor hot tub is subject to availability and requires advance reservation.
Each session lasts 60–90 minutes and is available between 10:00 and 18:00.
Please note that heating the water requires preparation time, therefore we kindly ask that reservations be made several hours in advance.
Use of the hot tub is at the guest’s own responsibility, and children must be supervised at all times by an adult.
In case of unfavorable weather conditions or technical reasons, Fox Chalet reserves the right to temporarily suspend the use of the hot tub.
Glass or fragile objects are not permitted in the hot tub area.

The Guest understands that Tihna Spa House does not perform medical evaluations and does not make recommendations regarding the Guest’s fitness to receive the requested services, and that it is recommended that the Guest consult a physician before accessing such services.

For guest safety, certain massage services or spa treatments may be contraindicated during pregnancy. Fox Chalet reserves the right to refuse massage services or adapt services in the case of pregnant women.

Health Intake Requirement

For the safety and well-being of all guests, every client receiving massage services at Fox Chalet is required to complete and sign the massage intake and consent forms prior to their appointment.

Failure or refusal to complete the required forms will result in refusal of service.

Fox Chalet and its practitioners reserve the right to decline or discontinue treatment if the information provided is incomplete, inaccurate, or indicates a contraindication for massage therapy.

By this document, I release Fox Chalet accommodation unit, its management, employees, collaborators, and owners from any claims, damages, or actions resulting from the therapeutic services provided.

This declaration is binding upon my heirs and legal representatives. I also release Fox Chalet from any liability for loss, theft, or damage to personal belongings.

PART III – TERMS AND CONDITIONS FOR EVENTS AND RETREATS

Please read the terms and conditions for our events and retreats. Events and retreats may be organized directly by Fox Chalet or hosted for third-party groups (e.g., companies, facilitators, or external organizers). Depending on the type of event, the contractual relationship may be B2C (consumer) or B2B (professional/company), as confirmed in the event confirmation/contract.

GENERAL

Prices are in RON and include VAT.
Price changes and seasonal adjustments may apply.

EVENT DATE SELECTION

Selecting a date is mandatory for both parties. After the expiration of the period for selecting a specific calendar date for the event, Fox Chalet has the right to rent the reserved event space and accommodation rooms to other parties.

EVENT START AND END TIMES

Event start and end times are established in the confirmation.

Any subsequent changes to the agreed times require Fox Chalet’s consent. If event start or end times are modified without Fox Chalet’s prior written consent, Fox Chalet may charge additional fees for services rendered.

TERMINATION BY THE ACCOMMODATION UNIT

Fox Chalet has the right to withdraw from the contract without compensation for justified reasons, for example if:

Force majeure or other circumstances beyond Fox Chalet’s control make contract fulfillment impossible;
Rooms or events are booked based on misleading or false statements regarding essential facts;
Fox Chalet has reasonable grounds to believe that the use of services may jeopardize normal operations, security, or the public reputation of Fox Chalet, without this being attributable to its control or organization;
Unauthorized subletting exists;
An official order exists;
An agreed advance payment is not paid even after the expiration of a reasonable grace period set by Fox Chalet.

CANCELLATION BY THE CLIENT

Client cancellation must be made in writing (email). If the event is fully canceled by the client, Fox Chalet will charge the following cancellation fees:

Free of charge up to 60 days before the event;
Between 60 and 30 days before the event, 50% of the cost will be charged;
Later cancellations or failure to cancel will be charged at the total estimated value.

LIABILITY FOR DAMAGES

For damage to or loss of Fox Chalet’s fixed or movable inventory caused during the event or during event setup/dismantling (if the client handles decoration setup and dismantling), the client will be held liable by Fox Chalet, without the need to prove fault. In such cases, Fox Chalet may request the conclusion of an appropriate insurance policy.

LIABILITY DISCLAIMER FOR BROUGHT-IN GOODS

Fox Chalet assumes no liability for loss or damage. If such goods must be insured against fire, water, theft, damage, or any other risk, the client must obtain their own insurance.

SETTLEMENT OF EXPENSES

To the extent that Fox Chalet procures technical equipment or other services from third parties, it acts in the name and on behalf of the client. The client undertakes to reimburse Fox Chalet for all duly incurred expenses and usage and to indemnify Fox Chalet against assumed obligations.

The client is responsible for the careful use and proper return of technical equipment rented in their name.

These Terms and Conditions are governed by Romanian law, and any dispute shall be settled by the competent courts in Romania.

Consumer Information and Online Booking Rules

Pre-contractual information: Before completing the booking, you will be shown/sent information regarding the services, total price, applicable taxes, payment terms, cancellation policy, and accommodation conditions.

Conclusion of the contract: The contract is considered concluded at the moment the booking is confirmed by Fox Chalet (usually via automated email or written confirmation).

Correction of errors: Before completing the booking, you may review and correct the information entered; for any subsequent corrections, please contact us.

Right of withdrawal: For accommodation services provided for a specific date/period, distance selling legislation provides an exception from the 14-day right of withdrawal. Cancellations/modifications are made in accordance with the cancellation policy applicable to the selected rate/package.

Complaints: If you have any concerns or complaints, please contact us at contact@foxchalet.com for an amicable resolution.

Alternative dispute resolution (ADR): As a consumer, you may use alternative dispute resolution mechanisms in accordance with Government Ordinance no. 38/2015. Information is also available through the National Authority for Consumer Protection (ANPC).

Liability: Nothing in these Terms excludes or limits Fox Chalet’s liability where such limitation is prohibited by law (for example, for personal injury caused by negligence).
